Law No. 42/2019/QH14 dated June 14th, 2019 of Vietnam National Assembly about Amendments to some articles of Law on insurance business No. 24/2000/QH10 and Law on intellectual property No. 50/2005/QH11

This Law adds regulations on conditions for business of insurance auxiliary services and amends and supplements regulations on intellectual property rights registration.

Accordingly, insurance ancillary services include: insurance consultancy, insurance risk assessment, insurance calculation, insurance loss assessment, insurance compensation settlement support are conditional business (Clause 2, Article 3).

Insurance enterprises, insurance brokerage enterprises and other organizations with legal status are all entitled to provide insurance auxiliary services. Individuals are only entitled to provide each insurance advisory service (Article 93a).

Regarding intellectual property as amended by this Law, "famous trademark" is established on the basis of use, regardless of the registration procedure (Clause 1, Article 2).

Trademark owners are obliged to use their trademark continuously, if the trademark has not been used continuously for 5 years or more, the certificate of trademark registration will be invalidated (Clause 8, Article 2).
This Law takes effect from November 1st , 2019
